Data protection is of a particularly high priority for KFP Five Star Conference Service GmbH, Audio Visual Services Corporation SARL, KFP B.V., AVC Live Limited, KFP Austria GmbH, KFP Five Star Conference Service Swiss AG, Encore Venue Services LLC, Encore Staging Services LLC, Hawthorn Theatrical Limited and Concise Limited (collectively referred to in this policy as, and doing business under the brand of, “Encore”, or also referred to as “we / us / our / our”) and significantly determines our actions.
(2) Our website and the websites of companies and organizations affiliated with us can generally be used without providing any personal data.

§ 7 Does ENCORE share personal information?

Information about our customers is an important part of our business. However, it is not part of our business to sell our customers’ personal information. We share customers’ personal information only to the extent described below and only with companies in the ENCORE group or service providers that are either subject to this Privacy Policy or implement measures that provide at least as much protection as those described in this Privacy Policy:

  • Third Party Transactions: We only use your data to fulfil our contractual services (legitimate interest) or to analyse our services or improve our services based on information you voluntarily provide to our service providers to analyse the market or assess/improve our services.
  • Third party service providers: We engage other companies and individuals to perform tasks for us. Examples include, but are not limited to, fulfilling orders for products and services, delivering packages, sending letters or emails, maintaining our customer lists, analysing our databases, assisting with promotional activities, providing search results and links (including paid offers and links), processing payments (credit card, direct debit and purchase on account), submitting content, assessing and managing credit risk, and creating and analysing customer surveys. In particular, ensuring high-quality services is the focus of our efforts. To ensure this high-quality standard, we work with market research companies to regularly receive event-related evaluations of our service as well as to obtain a market overview of competitors and customers on a representative scale. These third-party service providers have access to personal information that is required to fulfil their tasks. However, they are not allowed to use it for other purposes. This includes sharing data with companies to prevent and minimise abuse and credit card fraud.

In all other cases, we will inform you when personal information is to be shared with third parties. This will give you the opportunity to decide that your information should not be shared with the third party.

Data transfers to countries outside the European Economic Area: When sharing personal information with third parties in countries outside the European Economic Area (EEA), we will always ensure that the transfer of information is in accordance with this Privacy Policy and applicable data protection laws. § 8 How secure is information about me?

We consider your security and privacy when developing our systems.

  • To protect the security of your personal information in transit, we use encryption protocols and software.
  • When dealing with credit cards, we follow the Payment Card Industry Data Security Standard (PCI DSS).
  • We maintain physical, electronic and procedural safeguards in connection with the collection, storage and disclosure of our customers’ personal information. These security measures include, where appropriate, asking you to verify your identity before we disclose any personal information to you.

§ 9 How long do we store your personal information?

We store your personal information to enable you to use our Services on an ongoing basis. We will retain your information for as long as is necessary to fulfil the purposes described in this Privacy Policy or as required by law, for example for tax and accounting purposes. We will notify you of other retention periods. We no longer rely on the Privacy Shield but continue to abide by the commitments below that we made when we became Privacy Shield certified.

ENCORE Group LP and certain of its controlled U.S. subsidiaries (collectively, “ENCORE” or “we”) participate in the EU-US and Switzerland-US Privacy Shield (“EU-US Privacy Shield”) programs for the collection, use, and retention of personal information from member states of the European Union, the United Kingdom, and Switzerland.

As set forth herein, we sometimes disclose personal information to third parties in order for them to perform functions for us If we disclose personal information received under the Privacy Shield to a third party, the third party’s access, use and disclosure of the personal information must be in compliance with our obligations under the Privacy Shield, and we will be liable under the Privacy Shield for the third party’s non-compliance unless we are not responsible for the event giving rise to the harm.

§ 11 EU General Data Protection Regulation (legal basis)

The EU GDPR requires a legal basis for our processing of personal information. Our legal basis depends on the purpose of the data processing. We rely on:

  • Performance of a contract when we provide you with a product or service, or communicate with you in relation to it This includes processing your personal information to accept and process orders, deliver products and services and process payments.

In connection with the provision of our services, we conduct customer surveys for quality assurance purposes and collect personal data in this context. The purpose of processing personal data as part of the customer survey is to gather feedback and customer opinions on the quality of our services. The aim of the survey is to better align our services with the expectations of our customers and to perform in line with their needs. For the survey (used exclusively for this purpose), we use the platform operator Medallia, which processes the personal data within the European Union.

Participation in the survey and the resulting provision of personal data is voluntary. Therefore, our customers will not suffer any disadvantages if they do not participate in the survey.

The legal basis for the invitation to participate in the customer survey is your given consent in connection with the signing of our offer for the provision of our services and thus based on Article 6 (1) a) DS-GVO. The legal basis for the processing is Article 6 para. 1 f) DS-GVO. The controller has a legitimate interest in analyzing customer opinions by means of scientific methods and storing the derived results.
